2008年9月28日，国家税务总局针对北京市地方税务局的请示作出了《关于个人通过网络买卖虚拟货币取得收入征收个人所得税问题的批复》主要内容为： 一、个人通过网络收购玩家的虚拟货币，加价后向他人出售取得的收入，属于个人所得税应税所得，应按照“财产转让所得”项目计算缴纳个人所得税。 二、个人销售虚拟货币的财产原值为其收购网络虚拟货币所支付的价款和相关税费。 三、对于个人不能提供有关财产原值凭证的，由主管税务机关核定其财产原值。 这个批复引起的争议点很多，笔者在本文只想分析其中一个问题,即对虚拟货币的加价转卖所得征收个人所得税，这是否意味着国家承认了个人之间倒卖虚拟货币的合法性呢？依笔者的分析结论，这个批复并没有给予倒卖虚拟货币行为某种合法性的认定，而且在理解上确实令人困惑。 首先，需要理解的是：被计算应缴税的所得（应税所得），税务机关并没有权利和可能性来完全认定是合法收入。众所周知，特别是民事性质的违法行为，本来就持着“不告不理”的司法管辖原则，因这些违法行为而产生的违法所得很大一部分都没有被受损方追索，这些收入也从来是被计入应税所得的。税务机关和司法机关的职能是不能混同的，认定收入的违法性并不是税务机关的职责范围，即使发现也只有向司法机关举报之义务，并无法定的最终认定权。因此，从国税局的这个批复内容，我们并不能必然反推出“国税局认定个人之间倒卖虚拟货币是合法的或是国家允许的”。 其次，看一下2007年2月15日十四个部委发了一个明确“禁止倒卖虚拟货币”的文件。这十四个部委分别是文化部、国家工商行政管理总局、公安部、信息产业部、教育部、财政部、监察部、卫生部、中国人民银行、国务院法制办公室、新闻出版总署、中央文明办、中央综治办、共青团中央。这个文件中对虚拟货币问题有具体规定： “中国人民银行要加强对网络游戏中的虚拟货币的规范和管理，防范虚拟货币冲击现实经济金融秩序。要严格限制网络游戏经营单位发行虚拟货币的总量以及单个网络游戏消费者的购买额；严格区分虚拟交易和电子商务的实物交易，网络游戏经营单位发行的虚拟货币不能用于购买实物产品，只能用于购买自身提供的网络游戏等虚拟产品和服务；消费者如需将虚拟货币赎回为法定货币，其金额不得超过原购买金额；严禁倒卖虚拟货币。违反以上规定的，由中国人民银行按照《中华人民共和国中国人民银行法》第32条、第46条的规定予以处罚。” 可以看到，至少在去年的相关文件中，还是明确“消费者如需将虚拟货币赎回为法定货币，其金额不得超过原购买金额；严禁倒卖虚拟货币。”那么，接下来，我们需要考虑的是，此次国税局的批复中所说的“个人通过网络收购玩家的虚拟货币，加价后向他人出售取得的收入”的行为究竟是不是2007年文件中所指的“倒卖虚拟货币”呢？笔者认为，这两个表述所代表的行为，性质是一致的。 所谓“倒卖”，依通常意义，就是违反规定或未经批准的情况下以投机的方式将所购之物高价卖出的行为。2007年十四部委联合所发文件中已经规定了“消费者如需将虚拟货币赎回为法定货币，其金额不得超过原购买金额”，这就意味着最多只能平进平出地买卖虚拟货币而不能在转手中获利。因此，转手虚拟货币获利的行为自然就是该文件紧跟着所说的“倒卖虚拟货币”了，那是被该文件“严禁”的行为，其违法性也明确无误。 虽然，从法律条文及理论上，我们可以得出这样的结论，即国税局此次批复明确对个人倒卖虚拟货币征收个人所得税，并不意味着国税局承认倒卖虚拟货币的行为是合法的。但是，这在实践中是有点荒谬莫名的。如果说，这类“加价转手出售虚拟货币”的行为仍然属于2007年文件中所严禁的“倒卖”行为，那么有谁会去为这样的所得去申报缴纳个人所得税？假如倒卖者来税务机关申报个税了，那么作为发现违法行为的税务机关是不是有义务要向有关部门举报这位来申报个人所得的倒卖虚拟货币者呢？这个新规定，是个让人困惑，让人越想越不明白的规定，难怪，连作为始作蛹者的北京市地税局也对媒体表示“出台实施细则的时间还未确定”。
