Judge Kimball has ordered SCO to pay Novell $2,547,817 to compensate for unjust enrichment and breach of fiduciary duty. The ruling could also have implications for Sun's OpenSolaris project.Read More...Shared by Allen Harkleroad (2) Charlie Oliver (0) CJ (81) Denny (15) Eugene (26) Fatsleroy (20) GerardM (25) Zac (3)- Denny said: In 1994 Sun negotiated a perpetual license with Unix Systems Labs for the SVR4 code in Solaris. In 2003 Sun paid for a modification to that agreement, to allow open-sourcing of the SVR4 code in Solaris. This modification was negotiated with SCO, which it now turns out did not have the contractual authority to do so. Novell owned those rights.Presumably Sun will now pay Novell some more money, I don't imagine Novell would refuse to allow the modification.
